GENERAL TERMS AND CONDITIONS OF THE AMAZIHA COMPANY
- § 1 GENERAL
- The Amazihaonline shop is aimed exclusively at consumers. According to § 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to your commercial nor to your independent professional activity.
- 2. These General Terms and Conditions apply to all purchase contracts concluded via the Amaziha Online Shop between us, Amaziha Jewelry & Co. GbR and you in your capacity as a consumer.
- 3. The version of the General Terms and Conditions available on the websites at the time of the conclusion of the contract and therefore valid is decisive.
- § 2 CONCLUSION OF CONTRACT; RESERVATIONS
- By completing the ordering process by activating the “Buy now” button, you bindingly declare your offer to purchase the goods selected by you (order); we immediately confirm receipt of the order by e-mail to the e-mail address provided by you. The confirmation of receipt does not constitute a binding acceptance of the order; however, it may be combined with an express declaration of acceptance.
- We are entitled to accept the contractual offer contained in the order within three working days of receipt. Acceptance of the order by us shall be made by confirmation by e-mail or by dispatch of the ordered goods. The purchase contract shall only be concluded with this acceptance. We are entitled to refuse acceptance of the order, for example after checking your creditworthiness. In this case, we will inform you of the rejection in writing or by e-mail.
- 3. we reserve the right to sell goods only in household quantities.
- 4. we sell only while stocks last.
- 5. after completion of the input and before the binding dispatch of the order by activating the button “buy now” you will be shown all order data collected; you have the opportunity to correct input errors here.
- The text of the contract will be stored by us and transmitted to you by e-mail together with these General Terms and Conditions after receipt of your order.
- § 3 PRICES, COSTS & TERMS OF PAYMENT
- The price stated in the Amaziha Online Shop at the time of the order is binding. The price includes the legally valid value added tax, if applicable. In the case of delivery to countries outside the European Union, no value added tax is charged. We do not bear the customs and import tax charges incurred in this case.
- A price offered as part of a special offer is only valid for the duration of the special offer. Special offers will be marked as such.
- All prices include the statutory value added tax. Please note that shipping costs may apply. You will receive information about the shipping costs during the ordering process and in the
service area . - In general, all payment methods displayed during the order process are available to you. There are no additional costs for using the different payment methods. Please note that there may be bank charges for transfers from abroad. The amount depends on your respective credit institution.
The invoice will be sent immediately after the order to the specified e-mail address.
In the Amaziha Online Shop you have the following payment options:
- Credit card: You have the possibility to pay with Visa and Mastercard. We use the payment service provider Stripe.
- PayPal: During the ordering process you will be redirected to the website of the online provider PayPal. You must be registered with PayPal and logged in with your access data.
- – Instant Bank Transfer
- Amaziha Gift Card: You can pay with the Amaziha Gift Card. To do this, you need to enter your gift card number and gift card PIN in the order process.
Please note that we reserve the right to exclude certain payment methods after the result of a credit check.
- You only have the right to offset counterclaims insofar as your counterclaims are undisputed or have been legally established. You can only assert a right of retention on the basis of counterclaims that are based on the same contractual relationship.
- § 4 DELIVERY, DELIVERY TIME & SHIPPING COSTS
- We deliver worldwide. For order processing, the billing and delivery address must be within the same country.
- The binding period within which we will deliver the goods to you in the event that we accept your order (delivery period) will be displayed to you during the order process. The delivery period begins on the following working day after receipt of your order.
- If the goods cannot be delivered for reasons for which you are responsible, additional shipping costs will be incurred for a new delivery. In this case, you will have to bear the return shipping costs. In the event of a revocation, section 7 shall apply with priority.
- § 5 RETENTION OF TITLE & ACTIONS
- 1. The delivered goods remain our property until full payment of the purchase price.
- 2. you have to treat the goods with care until the transfer of ownership. You may not use the delivered goods for any other purpose.
- You may neither pledge the delivered goods nor assign them as security before the transfer of ownership. In the event of seizure or confiscation or other dispositions by third parties, you must notify us immediately in writing.
- 4. We reserve the right to reclaim products from gift promotions granted without legal obligation if the conditions for granting the gift are not or no longer fulfilled.
A prerequisite for the granting of such a product is that the purchase contract is valid in the amount of the minimum order value. If you return the goods to us in whole or in part, e.g. by exercising your right of withdrawal, and thereby fall below the minimum order value, you will no longer be granted an additional product as a gift for this purchase, even retroactively. In such a case, please return the promotional product to us together with the returned goods. - 6. LIABILITY FOR DEFECTS
The legal regulations of liability for defects apply.
- § 7. REVOCATION
You have the following right of withdrawal:
RIGHT OF WITHDRAWAL
Cancellation policy: You have the right to cancel this contract within 30 days without giving any reason. The statutory revocation/return period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
Beyond the legal withdrawal period, Amaziha gives you the possibility to return the goods up to 30 days after receipt and thus to withdraw from the purchase contract.
To exercise your right of cancellation, you must notify us (Amaziha Jewelry & Co. GbR, Goetheallee 26a, 01309 Dresden, hello@amaziha.com) of your decision to cancel this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). You can use the attached model cancellation form, which is not mandatory.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Excluded from revocation are goods that have been made to customer specifications or are clearly tailored to the customer’s personal needs (e.g. engraved items). All engraved jewellery is intended for final sale and has been engraved according to the customer’s instructions. Amaziha is not liable for errors that are based in an instruction or specification of the customer.
Exceptions to returns or exchanges:
Some products cannot be exchanged or returned – this includes jewellery made especially for you. In addition, incomplete or damaged items cannot be exchanged or refunded.
CONSEQUENCES OF CANCELLATION
If you cancel this contract, we must refund all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received the notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the end of the period of fourteen days. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to your handling the goods in a way that is not necessary for checking the condition, properties and functioning of the goods.

- § 8 APPLICABLE LAW
The law of the Federal Republic of Germany shall apply, with the exception of the UN Convention on Contracts for the International Sale of Goods, the applicability of which is hereby expressly excluded. This choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
- § 9 ONLINE DISPUTE RESOLUTION
